I think they are completely different, but I wouldn't be worried about the lawsuit at all. I've gone over the Patent abandonment laws months ago and even called the patent office. The only thing we need to worry about is maintaining volume once we get FDA approval and hope we hear back from the independent Texas study soon as well.
