That's irrelevant, SPA rules are based on law; once an agreement is reached it can not be changed because of opinion, which was clearly the case (see my references used with 3 Judge panel). Purpose of SPA is to prevent moving bar scheme, the reason why Congress made SPA law.

Another law, FDA doesn't regulate the practice of medicine; FDA CAN'T ELIMINATE THE VALIDITY OF TG AS SURROGATE MARKER, but in 2013 this is what they did by rescinding SPA. The FDA believes their opinion to be FACT, this also seems to be your issue.
