I believe you answered your own Question, providing your numbers are Correct.

You asked for it.

Quote:
According to the American Intellectual Property Law Association, the cost of an average patent lawsuit, where $1 million to $25 million is at risk, is $1.6 million through the end of discovery and $2.8 million through final disposition.

Now, as of 2016 microsoft net worth is around 407 billion market value. (in case you didn't know its the Golliath of the software industry.) So with a market value of 407 billion at risk how much would patent litigation potentially cost microsoft?

Was it cheaper for microsoft to settle for 9 million or fight patent litigation?

Why not Litigate at a cost of $2.8M and drag things out, rather than Payout 3 times that $9.7M ?

Microsoft needed to continue to Push out AZURE AD, unencombured by a Patent Lawsuit Looming, perhaps with a court-ordered cease and desist order, losing and facing far more than $25M in a Jury Award or Far more than $25M past Royalties, due to waiting for the case to go through Jury Trial and AZURE being utilized by the world in 128 Countries. Gee that's a lot of people Microsoft touches in a day using AZURE, wonder how many acesses that equals during a Suit time period that might go to Jury Trial ?

Not to mention the Patents had already under went the Scrutinizing of a Markman hearing in the PhoneFactor case.

Your Honor, I would like to submit the recent Markman hearing into evidence and expert witness testimony therein.

If it please the Court, May we move forward with a Jury Trial in an expeditious manner.

"So with a market value of 407 billion at risk how much would patent litigation potentially cost microsoft?"

I don't know, MSFT is a Public Company with Shareholders whether it's $2.8M in litagaion or $100M+ in Jury Award Damages, Plus $$$$? lost Royalties by SFOR, at some point MSFT would have to justify to the Shareholders the risk of taking the case to court, more than the short time in which they caved in and paid SFOR.

If shareholders got wind of a Jury Award and other Damages of $100M + it would not look good for shareholder value... So heres $9.7M, Shutup and heres an NDA, to make sure your lips are sealed.

Going to to trial and losing?? Yeah MSFT might be able to Cover it all up in and NDA, and hide the cost among everything else and buried deep within all their Billions in the Financials.

Of course that does not preclude some enterprising person going on a MSFT Stock board an dropping a hint or two. If the whole thing did not hit the MSM first. For now, respctfully, go back through the boiler room hole in the wall in which one may have crawled from until after the Current Lawsuits are won or Settlements have been announced. Or StrikeForce loses, if the later were to happen come back and say I told you so. C'est la vie
