45. If the TetraStem product was sold directly to physicians (as stated in EXH17) by Otiko's ViaDerma company along with the stem cell growth-promoting claims or suggestions as described and promoted by Phillips and Otiko, then those sales were highly illegal under the Food, Drug and Cosmetics Act that is enforced by the FDA and other agencies. Upon information and belief, this is what was done by Otiko and Phillips. Further evidence indicates that this illegal operation is now expanded with the involvement of other Defendants Adams, Biogenx and Neurogenx involving the sale of ViaDerma's/Biogenx's VitaStem branded product, as further described below.
