Just to chime in, clearly 'no' is the only possible answer.

They may have a right to acquire partial ownership, but they aren't yet partial owners.

One advantage of not being an owner is that the patent is out of harm's way if any MaxD creditor goes after it. Thus, perhaps, the little grey area dance.

Anyone know how the costs award in Northern California is shaking out?
