I don't think so, since merger never consummated

I suppose that there is a slight chance that LIBE could be considered a debtor, but I don't think that the deal officially closed and on March 6, 2017 (several weeks before the petition was filed,) LIBE issued an ammended 8-K that stated that it had terminated the deal.
