If I had to guess, I'd say it was a combination of Barton pulling the strings and Chieco not being in on the stock conversion side that saved him.

That 'Pro-Forma' was reported by me and I'm sure many others to various agencies as well as some of the entities listed on it so I certainly wouldn't rule out the idea of him giving information to get Barton and save his skin.

Then again, without reading the complaint again, did Sindleman get any money from the conversions or did he just get nailed for facilitating the conversions for the others?
