That was not the part of the statement I was referring to when I said at "their discretion". The part I was referring to was this-
"In the event VPN determines" I don't think its much of a twist at all to say if they are the ones making the determination, it is at their discretion.

I will be the first to admit my opinions are subjective, I thought that was the very nature of opinions. But I do post many facts with my opinion like this one-
"FROM THE AUG. 14, 2006 [10Q]
On June 7, 2006, the Company entered into an Initial Network Installation Agreement with VPN de Mexico...
VPN has paid a $225,000 deposit to GlobeTel as 50% of the initial cost of the network. ... In the event VPN determines that the network does not operate in accordance with its expectations, then the $225,000 deposit will be returned to VPN by the Company."
If that is not factual, its not my fault.
