That's only part of the equation. The other factor was: who exactly was the infringement suit against? Microsoft was the parent company. It was PhoneFactor who was infringing, and I bet a $10m loss would have hit them straight in the nads if it wasn't for Microsoft acquiring them. More importantly, what that settlement did was prove the validity of SFOR's claim for future suits, which is why we have 3 suits pending, with more on the way. MS saw the writing on the wall, and knowing that they themselves are infringing on the patents with their OOBA/MFA solutions, cut a licensing deal with SFOR to stave off a bigger suit down the road when SFOR starts going after the big dogs.

Finally, I think if you look at all the pieces together: the slow and deliberate postitioning of all the catalysts, methodical approach to litigating infringers, increase in revenues, marketing, contracting deals, and other factors, I think that points to a company with very STRONG leadership, not weak. Do I wish the train would get going a bit quicker? Sure! But I think Kay and co. knows EXACTLY what he's doing.
