Flyhigh, you seem to have turned to other boards to ask simple questions. You are getting complicated answers there. The simple answer is that the FCCOA appeal is now argued. There were written arguments filed before the hearing and these included legal briefs and supporting materials.

The panel, which included the Chief Judge of the Federal Court of Appeals, then heard oral argument. And now that's over. The judges are writing a decision and will release it. Their decision is effectively final. Very unusual for a case to go to the US Supreme Court from here.
