I don't know, but I expect the SEC to warn before suspending.

I do believe KJ is deliberately not filing to hide the facts as long as possible... but a shell with dirty history is still worth a lot more than a suspended shell.

He could also be holding back filing until he can release a huge positive news story at the same time, so investors are distracted from the dirty laundry.
