I think (typically) in legal spheres, if something changes past decisions are usually left as is (as whatever basis was used in decisions prior to the change were according to the standard at that time).
Based on "typical" law I don't think that assertion would make sense but curious to hear why / where you get this view from?
I do agree the patent landscape can't get any worse and with Trump in charge hopefully his decisions at the pto and court levels are pro constitution meaning pro patent
If so, it could benefit this whole sector a great deal. This is why I've started looking at these stocks now. But until we see who's selected for key roles, we won't know for certain what the new climate will look like.
