Ridiculous argument. If the Supreme Court rules that AP Judges are unconstitutional they are unconstitutional in every state in the country.
In the dissenting opinion on Bandimere 10th Circuit Federal Judge Monroe G. McKay's main concern was "all federal ALJs are at risk of being declared inferior officers." He said there are 1,537 Social Security Administrational ALJs alone. "Despite the majority's protestations, its holding is quite sweeping, and I worry that it has effectively rendered invalid thousands of administrative actions," he said.
When the Supreme Court ruled that "the right to privacy" under the 14th amendment to the Constitution included a woman's right to an abortion (Roe v Wade case) it did not only apply to the state of Texas. This ruling made abortions legal in all 50 states.
