One court ruled it Constitutional

The Court of Appeals in the District of Columbia said that it was constitutional.

The 10th District Court of Appeals in Colorado -- an equal of the DC Court -- said it's not.

The Supreme Court will have to decide which court is correct.

That's how these things work when two or more Courts of Appeal have differing opinions.
