a. The judge did not issue his initial decision at the 300 day mark. So, the 300 day old rule applicability has vanished.
b. The judge was supposed to file for extension for the initial decision delay 30 days before the initial decision due date. There is none. This is a further evidence that the 300 day old rule does not apply.
What guidance would you use then. One would use the new rule guidance that says the judge has 300 days from post hearing briefing to deliver his initial decision. The post hearing briefing was submitted on October 28, 2016. Add 300 days to that, it will put us on August 24, 2017.
