I've posted in here several other facts that are not on the perimeter anymore. SA has 22 felony counts stacked against him. The legal costs have to be dwindling and putting a severe strain on his cash supply. MW suspects this also and logically, SA has always been the money man in the game, JS is broke. The reality of mw getting $3.5 MN + from these guys would cost him and the company more time and money than its worth. Simple economics really. SA has his money (what's left) so it makes no sense to move foward.
The second factor is time. Dragging this case on for even one more day is a drain on energy that's best served building the business. Good decision to move on and taking the words and twisting them a little from Harry S. Truman, "that's what I call CEO'ing."
Last. I think we all knew a settlement was inevitable. No way JS and SA would let this get into the court room. Again they have nothing to leverage. $400 k was easy to walk away from consider door number 2. Jail!
