At issue is whether a taking occurred. I think it has. The gov't says that it hasn't. The documents would likely be instructive on the issue. The documents are not able to be gotten anywhere else. The judge reviewed each document.

Very much like the gov't asserting the markets would "panic" if docs were released. Docs were released. The only panic was where Bill Clinton was going to meet the "energizer bunny" and where Chris Christie was going to get his "bunny tracks" ice cream. No other panics occurred.
