I believe he is saying that since he knows of lawsuits that the company has not filed an 8k for, it becomes equivalent to insider information. The company's failure to file may have created a problem for anyone that stumbles across the lawsuits.

EDIT: It is kind of a stretch, but he is trying to make a point.
