If NWBO owes Cognate money for manufacturing shouldn't Cognate be repaid?
If Cognate carried NWBO for a period of time and at the same time manufactured the experimental product that NWBO needed to use in its trials should NWBO have the ability to sue Cognate for anything because without Cognate NWBO would have nothing.
If LP set up Cognate to be separate from NWBO for the purposes of protecting NWBO's intellectual property/experimental treatment wouldn't it be self defeating for shareholders of NWBO to be allowed to sue/destroy Cognate if the experimental product fails in some way.
NWBO together with Cognate are existing to test the experimental product DCVAX, why would you want to allow the benefiting shareholders of the public company to sue the private co. The private company is only set up to produce and sell the product to the owner NWBO. The private company has to protect itself from shareholders to get paid. So LP makes sure Cognate will get paid for its services and NWBO gets its experimental product...win/win. I mean with an experimental product being manufactured how can the company making it be liable for it, it is an experiment, it has inherent risk, will it work or not due to all sorts of things. What benefit is it for Cognate to purposely make a bad product. And Cognate never owes NWBO any money, it is always NWBO owing money by buying the product from Cognate.
Aren't you trying to stir the pot and create a problem that doesn't exist to cause issues.
