Would love to see that post since i'm new here. A couple of things, licensing deals are contractual by nature and not the product of any judicial mandate/decision. It's a private party dealing, but can also be as a result of arbitration or simply a product of settlement negotiations. Tying up the court system for a licensing deal implies there was a contract already in place (offer + acceptance + consideration) and that there was a breach....that's why people generally sue. So I'd love to see the context because I don't believe there was a pre-existing licensing deal. But, let's not forget that Kay is a busy man, may have answered a question in a different context, or read a question in a different context, or the biggest reason...was under a NDA. Who know's?
