So long as Nok is not in default and they are not until the rate is set by the arbitration panel, Nok will seek the same commercial benefit that Ericy received under the MFL. We do not know what the terms of payment are for the 2002 royalty because it is redacted. We know that certain discounts are allowed after 2002, but they are predicated upon paying 2 years in advance. The arbitration panel will have to make that determination or perhaps a stipulation will be reached by the parties to cover this matter. IDCC is not going to quibble over discounts if they can get this matter resolved.
