When the ruling was made by Casper in regard to the USPTO correction she stated that the current case could go on but would be limited to damages from the point of correction and not back from there. Both parties agreed to move forward from that point.

She did also say in her judgement that a new trial would have to be opened to include the whole enchilada. That said she made light that there was nothing stopping another trial after this one was over. All that said it would stand to reason that is this one was ruled in worlds favor that a settlement could be swiftly reached to address the damages pre-correction as worlds would almost be assured victory in a new trial.
