I could be wrong on this as I am not a lawyer but I don't believe WDDD would go to trial without first addressing the patent chain issue.

I dont think the process is like an "appeal" since there has not yet been a trial. My guess is they would file a motion prior to trial to have it addressed as you wouldn't want to go to a jury with the jury not knowing what the potential real damages are nor the defendant. To me that just doesn't make logical sense .

It would create more costs and time to the courts as well and they tend to want to do things at least in an efficient as possible manner (as best the courts can)

I'd be curious to know the real process from a lawyer
