That's unknown at the moment. Just like any other litigation, all the evidence has to be presented to the court and every document listed as such. This has become a regular form to sign and submit as it protects confidentiality in law-enforcement cases, patent infringement cases, etc...

I'm really surprised to see this actually going to court. After losing to Microsoft, their attorneys either:

1. Think they have something StrikeForce hasn't thought of and is prepared to battle this out and even put together a counter suit or...

2. This is a tool to make Strikeforce think they are prepared to go to court and hope that helps in a pre-trial settlement, lowering the amount they settle on.

Time will tell. There's no way to know how this will unfold but its my opinion the outcome is known. Go StrikeForce.
