Hey longusa,

Left to play golf right after the conference call started; needless to say was stunned by the FTC decision, but not really. No shareholder with any experience could honestly say they were surprised by the news.

Think you have it right. Seems to me this ruling was intended to wipe out any past MM infringement damages for SDRAM and DDR and set future rates at less than 1% for SDRAM and less than 2% for DDR. This arrangement would not be in conflict with the Infineon deal. Further, the protracted remedy phase process gives the MMs and Rambus time to settle privately along the guidance the FTC suggests in its footnotes.

Rambus and its outside counsel will go over this decision and its potential current and future legal and licensing implications with a fine tooth comb. Assuming there are no hidden surprises, can only see Rambus appealing the decision if the final FTC remedy is unacceptable or it believes the MMs will not settle by some date certain.

But this is just my uninformed opinion. Check that. Make that my hope...

Today's FTC decision makes clear Rambus will never collect what it believes it is rightfully owed for Rambus IP used in JEDEC-compliant SDRAM and DDR memory, so the time for fighting is over. Rambus needs to cut its losses. Sign the MMs to broad technology licenses and start moving aggressively to sign more of the controller, systems, and consumer electronics companies as well.

Mr. Danforth earned his pay. Now it's time for Mr. Hughes and Ms. Holt to earn theirs.

Just my opinion.
