Joel, I agree with your post that the delay tactic does imply fear. If they were so confident of their position, there would be no need to delay the arbitration. My question is what right do they have to request any sealed documents related to Ericy. In effect those documents are no different than any other negotiations leading up to final contract. Why not ask for all notes, emails etc for any and all contract negotiations IDCC has had with all their licensees? I just can't see how they could be successful in their request but much stranger things have happened.

As far as Nokia having financial pressure, I doubt it. I read a while back that Nokia has over $8 billion in cash. Although the $300 million they owe us would put a dent in it, it would not cause a financial hardship. I guess they didn't accrue enough in their estimates and don't want to have to record additional expenses as a result of this, especially when their results were not as high as analysts wanted.

I hope management has grown a big set and let everyone know it today at 2:00.
