They swear to uphold the Constitution



All servants are sworn to uphold the constitution! So why is it that courts rule on it?

It is not the courts place to be ruling on constitutional matters, this would be in the hands of the voting population of the US IMO they and other agencies would be enforcing the peoples constitutional rule not the other way around.

Now tell me how wrong I am!
