Mickey you go to arbitration to set a rate when there is disagreement over the amount to be paid for the PAST PATENT USE.

Notice I did not mention infringement.

To clarify to use without payment or agreement is infringement.

Arbitration is initiated when the parties agree the patent use is happening but cannot agree on a rate.

Infringement is normally proven in a court or other adversarial venue such as the ITC.

In summation Huawei has agreed to patent use and a rate they will pay as set by the arb panel.
