I am positive on both fronts that they do not have paying customers, obvious from the year end financials that state they had no revenue in 2015 and expect revenue in either the 2nd or 3rd qtr. 2016, but they can't be sure it will happen in either qtr.

We anticipate commercial sales during the second or third quarter of 2016, however we cannot be assured that this will be the case

If they had a single paying customer or a real revenue producing contract that would be material event and would have to be publicly announced within three days of it happening for fully reporting penny stock companies!
