It's not NITE's call; it's your broker's. Your broker was reponsible for accurately transmitting your order to the MM...THAT'S HIS JOB! The broker screwed up. The broker has to eat the damage. Sometimes a MM will want to preserve the business relationship with a broker and will cancel a trade to cover the broker's butt, but he doesn't have to.

The brokerage supervisor is BSing you. Talk to HIS supervisor.
