Differences between Ericy case and Nok negotiations

In the Ericy case, the stakes were high for both parties. A major loss by either company may have meant the end of that company as an independant entity. In the Nok negotiations, the stakes are similiarly high for Idcc but not for Nok. The chances of winning against Ericy in court were at least as good as getting what is owed from Nok without arbitration. The rewards of winning against Ericy were however much higher than getting what is owed from Nok. Idcc backed down and let Ericy off the hook for reasons best known to them. They can not afford to do this with Nok. I think both Nok and Idcc understand this and that is why I believe that in the end Nok will pay what they have owed since January 2002.
