as for impairment, I think the roadside sobriety test works objectively. I wouldn't pass that drunk, high on heroine or many pharmaceuticals, but I would pass a road side sobriety test all day long like I stay high all day long

With that test they have a line, did the subjects foot touch the line or not - that is OBJECTIVE - two independent observers can look at the same event and record their observation - the test can be duplicated and the results come back the same - if you drink too much you are impaired so badly you can't put your foot on paint even when your liberty is at stake
