On March 19, 2012 (the “Effective Date”), the Plan became effective and certain of the Debtors’ assets were transferred to a newly formed Delaware liquidating trust (the “WMI Liquidating Trust”) as further described in the Plan.



The problem lies in the wording; if they just would have said “all of the Debtors’ assets” instead of “certain assets” it would have been clearer. “Certain assets” tell us that all have not been transferred. What the other “certain assets” are and why they were not transferred yet is the unsolved mystery.
