No denying that SEC alleges the respondents breached a Maryland cease and desist commitment. Not sure if there is any jurisdictional issue on this. That said, if there is no jurisdictional issue and Biel officers/directors are found guilty, I would expect much heavier fines and possibly the bars already discussed. Will the fines be heavy enough to wipe out the company financially? Does Biel pay those fines or the individuals and other corporate entities named? Probably if the administrative hearing goes against A. Whelan et al there will be a loss of confidence among shareholders. Still, there is no way to legitimately predict an end to the company or what, if any, impact this will have on the pending FDA decision.
