The current 2002 List is unnecessarily burdensome and expensive. It is currently comprised of approximately 200 parties. As a result, KCC has estimated that the cost of serving even a succinct pleading such as the Motion is approximately $1,100. In isolation, this cost is steep. In reality, where motion practice is, at times, extensive, the costs of service are multiples more and can rival the dollar amount of the claims the Trust is seeking to resolve. For example, the costs of serving this Motion pale in comparison to the approximately $39,000 in recent service costs incurred by the Trust in connection with the Kareem Claims and Appeal.

The 2002 List is stale. Nearly all claims in the above-captioned chapter 11 cases have been fully adjudicated and resolved and
parties in interest are few. WMILT has made substantially all distributions pursuant to the Plan and the few Outstanding Matters are all that remain. As a result, parties who once had a dispute with the Debtors or WMILT and desired to receive all documents filed in these chapter 11 cases may no longer wish to receive such notice. However, because the burden of requesting removal from the 2002 List is higher than the alternative of continuing to receive notice and trashing unneeded documents, many “uninterested” parties do not seek to be removed. Indeed, in 2015, the Trust has received only a handful of requests from parties wishing to be removed from the 2002 List. Restarting the 2002 List would alleviate related burdens for the benefit of all parties and allow the list to serve its true
purpose.



All that about Susman still in the game with the LT? A bunch of bull. Just laziness on their part of not getting removed. Laziness on the parts of many for not filing a removal request.
