If you think that NSS does not or can not exist prior to 2005, than you need to listen to what this has to say.

For anyone to contend that they know what the NS position is in any of these pink sheet stocks...is significantly ill-informed. All NSS before 2005 were grandfathered in by the SEC under regulation SHO.
