Walthers could turn around and sue Adelstein , etal. Which, some folks say he will do. There is a possible counter-suit on the books. But, since the judge already dismissed Ol' Joe from that suit, and since MW seems incapable of paying an attorney, that suit will go by the wayside when MW loses the Federal RICO suit.
Interesting that you say you have three attorneys that say Adelstein will lose everything. The attorneys I talk to are Securities Lawyers. They are quite familiar with corporate borrowing & lending practices and the application of Federal Law/Statutes governing these situations in the corporate world. They "politely" disagree with your attorneys.
