No, a chasm has not been crossed. It is quite the opposite, they are in a very deep chasm. They are unable to use registered shares due to the crappy financial shape of the company. So now they have to go to unregistered shares which carry all sorts of restrictions.

Their avenues of funding are becoming narrower and narrower.

Being "wrong" has been extremely profitable.
