Spoke to Etrade. They had to connect me with someone familiar to the matter. Basically the validity of the payment has been questioned, so the funds will remain on hold until pending litigation is resolved (she specifically told me they were waiting on the outcome).

IMHO I don't see why you shouldn't be able to transfer everything.
