And yet strangely YIPI and Granville have pleaded NO EVIDENCE at all to support those claims.
Under Iqbal, which is a Federal case on pleading sufficiency, pleadings should state nott only the claims butt also supporting evidence that will be proven - at least in summary form.
This is a NY state case, so Iqbal is nott mandatory authority, butt I would expect that NY courts, which are nott backwaters, would have adopted a similar rule for pleading with particularity and supporting evidence.
Yett Granville and YIPI have provided NONE.
And the 21st is when the court has the hearing on the Motion to Compel filed by Magna, after which it will make a ruling and schedule a revised trial date and discovery deadlines. That is all that will happen on the 21st.
Oh, and rule on Magna's request for SANCTIONS against Snyder and YIPI for failing to comply with now three court orders to produce discovery - as the court's own attorney overseeing discovery asked Magna to do (file a Motion to Compel). Yeah, so there's that. $$$$$
