Delaware case attacks net worth sweep, and the net worth sweep is de facto nationalization and its an anchor for status quo. If it’s struck down, they can’t go back to the old deal, which is uncertainty for the housing market.

The discovery in Delaware case is trivial, so they don’t need all this haggling about protected information. There will be jury deliberations deciding on the compensation. It’s a kiss of death for status quo. And then they have to either nationalize or release. That is if they want to go through the Delaware case.

The old cases require discovery and jurisdictional issues and lots of arguments.

The Delaware case is a bit of arguing about public information. Plus Delaware case opens the door to many more suits. It’s a death blow for government defense
