If indeed there is no functional company with no verifiable mines in Mexico there would be sufficient reason for the SEC to suspend the stock under questions about adequacy and accuracy of information, corporate structure, and share issuances.

Yes. But in this phase of the investigation, it'll be mostly FINRA that'll deal with it. And if the SEC suspended, the suspension would replace the U3 halt, as it did with CYNK. U3s can be kept in place for as long as FINRA wants, and I suspect they and the SEC will agree that's desirable in this case.
