I would say that, there is a possibilty of prosecution if they do not follow through. However since they haven't filed with Finra yet it might only be a class action suit if they do not follow through. This is a moment of truth for the company.

If they do pay, and I hope they do, it should restore a lot of faith in the company. Which should help share prices dramatically. If they do not, I would look for a lynch mob of people chasing them down.
