declan, I understand you concern regarding this suit potentially having unintended consequences in terms of the media twisting and sensationalizing it into a "Look...Big Drug Companies are trying to kill off the FDA and soon rat poison allowed in baby food as a result" type of story.

There have been numerous articles published in the last week sounding the same alarm (OK...minus the rat poison business). IMO, most of these these ring hollow and are quickly negated by simply by thoroughly reading the actual complaint. Res Ipsa.

Inasmuch as the complaint's scope is so narrowly limited to the issue of ensuring that Amarin would be shielded from Civil and Criminal prosecution for the sharing of TRUTHFUL and NON-MISLEADING (emphasis added) speech and information,(as is Constitutionally protected by 1st Amendment right) it would be very easy to rebut an article written by some alarmist or Amarin foe.(What better method of rebuttal than having a Federal Judge issue the injunction).

Additionally, other than dismantling the FDA's Constitutionally illegal "gag order" and because the complaint does not seek modification or elimination of any of the FDA's other procedural elements(such as HOW a drug is approved etc.), the FDA would look extremely silly trying to sound a public health alarm on this case.
