Remember your Constitution lessons from school: 3 branches of gov't, each independent from each other. FDA is HHS and Executive branch. Review of its actions is provided by the Constitution, and statutes enacted by Congress[Legislative branch] thereunder, by the Judicial branch. Worked quite well since the 1780s.
