Well the FTC disagrees with you:

The manufacturer or dealer can ask the FTC to waive the rule prohibiting them from voiding consumers’ warranties for using aftermarket or recycled parts. The FTC may grant a waiver if the company shows that the product will function properly only if its parts or service are used, and the waiver is in the public interest.



It is clear that Tesla is relying on this FTC rule since they clearly state any modifications made by non-authorized entities will not be covered:

Any repair, alteration or modification of the vehicle, or the installation or use of fluids, parts or
accessories, made by a person or facility not authorized or certified to do so;



If Saleen claims they are modifying the drivetrain, then Tesla has all the rights to not cover any cost of repair on the drivetrain.
