It is interesting that Judge Essex points out the impact of the CAFC decision on Nok/MMO but ignores the fact that the ITC sat on the CAFC decision for OVER A YEAR during which it issued conflicting claim constructions in the 800 investigation.

Do you think the full Commission is obligated to reconcile the conflicting claim constructions as part of their review?

PS I was also reminded that the original 613 FD issued just over two months after the ID. Hopefully the remand FD will also be expedited.
