I think that Wave appealed for one primary reason: because they could. Such an appeal obviously buys them time. The stock price could go up, it could go down, but they had nothing to lose. The theory that they appealed because they were confident they could get the SP over $1, and avoid delisting, is the stuff that Wavoids (myself included) have been preaching since Linda Tripp started taping Monica Lewinsky's stories of kneepads and cigars. Back in 1997 we were going to avoid delisting with a simple OEM contract, a contract that was all but promised by Wave but never materialized in time. This time, and rightfully so, no such promises are being made. Maybe news will come out that will bring us over $1. Maybe the SP will get there for a variety of other reasons. But to me the question is not really why would they appeal, it's why wouldn't they appeal? Nothing to lose...
