"inequitable conduct" is a defense and the burden of proof is on the defendant. As such, it is presented by the defense after the plaintiff rests it's case in chief. It looks like judge
Andrews has decided to try this defense after the NOK infringement/validity trial. This would be time and money savings because should IDCC lose infringement, then there is no need to try defensive issues.
