rmarchma, good post. I agree completely with your analysis of the situation. IDCC was careful to craft the language in the ERICY/SONY contract to make it clear what amounts apply to which periods. The $14m was for pre-2002 handset sales, the $20m was for 2002, and the rates for 2003 - 2006 are clearly laid out.

NOK could try to use Brokentrade's arguments, but it wouldn't hold much water.
